**Online Store Terms and Conditions**
§ 1 General Provisions
1. The online store is available at https://chartzone.pl.
2. The store is operated by ChartZone Aleksandra Kwaśniak, with its registered office at ul. Wąska 2, 32-651 Malec, VAT ID: 5492472396.
3. These terms and conditions define the rules for using the online store.
4. The data controller of the User’s personal data provided in connection with the provision of Electronic Services is the Service Provider. These data are protected and processed in accordance with the provisions of the Regulation of the European Parliament and Council (EU) of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data (GDPR). Providing personal data and consenting to their processing for the purpose of providing Electronic Services is voluntary but necessary to use services that require the provision of these data on the Website.
5. The Client can place orders through the store's website at https://chartzone.pl.
6. Copyright: All content, including texts, graphics, photos, and other materials presented on the Website, are protected by copyright. Copying, distributing, or otherwise using them without the Seller's consent is prohibited.
7. Changes to the terms and conditions: The Seller reserves the right to change these terms and conditions. Changes take effect after being published on the Website.
8. Products offered in the Store are made to order according to the client's personalization.
9. Product availability may vary depending on the order load and the specifics of the products ordered.
§ Obligations of the Parties
1. The Seller is obliged to inform the Client about the current status of the order and deliver the Product in accordance with the contract and free from defects.
2. The Client is obliged to use the Online Service in compliance with the law and good practices, taking into account the respect for personal rights, copyrights, and intellectual property of the Service Provider, other Users, and third parties.
§ Orders
1. To successfully place an order, the Client must first confirm that they have read these Terms and Conditions, accepted them, and agree to comply with them.
2. The Client can place orders in the Online Store 24 hours a day, 7 days a week.
3. To conclude a distance sales contract, the Client must select the Product, provide the data required by the Seller during the ordering process, and finally place the order by following the displayed instructions.
4. When placing an order, the Client is obliged to provide true and up-to-date contact information. Providing false or incomplete information may hinder or prevent the fulfillment of the order.
5. The Client can pay for the order by credit/debit card, bank transfer, or PayPal. The payment method is chosen during the ordering process.
6. After placing an order, the Client will receive an email confirming the receipt of the order by the Store, containing all the essential elements of the order. The sales contract is concluded when the Client receives this email, while its acceptance occurs after payment confirmation.
7. Order fulfillment begins after the Seller receives payment confirmation or acceptance of other payment methods.
8. The order fulfillment time may take up to 5 business days from the date of payment receipt for the placed order.
9. If the Seller is unable to fulfill the order within 5 days of placing the order, the Client will be informed, and if payment has been received, the entire amount for the unavailable product will be refunded.
§ Delivery
1. Delivery rules: Products purchased in the Store are delivered within Poland and other European countries listed on the shipping page at https://chartzone.pl/pages/wysylka.
2. Delivery costs: Delivery costs are determined individually and depend on the chosen delivery method and shipping address. Detailed information on delivery costs is available during the order process.
3. Delivery methods: The Client can choose from the available delivery methods, including DPD / InPost. The delivery method is selected during the order process.
4. Estimated delivery times: The estimated delivery time is provided on the shipping page at https://chartzone.pl/pages/wysylka. Please note that the provided times are estimates and may change due to circumstances beyond the Seller's control.
5. Shipment tracking: All shipments sent by the Store include a tracking number, allowing the Client to monitor the shipment's status. The tracking number will be provided to the Client via email after the package is dispatched.
§ Withdrawal from the Contract
1. Limitation of the right to withdraw from the contract: Products offered in our store are made to order according to the Client's personalization. According to the Consumer Rights Act (Article 38(3)), the Client does not have the right to withdraw from a distance contract if it concerns goods manufactured according to the Client's specifications or serving to meet their individualized needs.
2. An exception to this rule are products available on the sale page at https://chartzone.pl/collections/wyprzedaz, which are ready-made products. For sale products, the Consumer has the right to withdraw from the contract within 14 days from the date of receipt of the goods.
3. Form of withdrawal from the contract: The Consumer may submit a declaration of withdrawal from the contract using the contact form available at https://chartzone.pl/pages/formularz-kontaktowy. This may also be a declaration sent electronically to the email address: chartzone.store@gmail.com.
4. Return costs: The costs associated with returning the goods to the Seller in connection with withdrawal from the contract are borne by the Consumer, unless otherwise agreed by the parties.
5. Refund of payment: The Seller is obliged to refund the Consumer the payments made by them without delay, but no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract.
6. Condition of the goods: The Consumer is obliged to return the goods in an unchanged condition.

§ Complaints
1. Complaint period: The Client has the right to submit a complaint within 2 years from the date of purchase.
2. Complaint procedure: In the case of a complaint, the Client should promptly contact us via the contact form available at https://chartzone.pl/pages/formularz-kontaktowy or via email: chartzone.store@gmail.com. The complaint description should include detailed information about the defect and, if possible, photos of the defective product, the name and surname, correspondence address, and the purchase document number.
3. The Service Provider suggests including in the complaint description: (a) information and circumstances concerning the subject of the complaint, including the type and date of the problem; (b) expectations regarding the resolution of the complaint. Such a description will facilitate and expedite the complaint processing. The Service Provider reserves the right to request additional information from the User if the complaint is incomplete and prevents its consideration. The Service Provider will respond to the complaint promptly, but no later than within 14 calendar days from its submission. After considering the complaint, the Client will be informed about the course of action.
4. Possible complaint resolutions: In the case of a justified complaint, the Client is entitled to choose between repair, replacement with a new product, or a price reduction in accordance with applicable regulations.

§ Exchanges
1. The Client may exchange the purchased product after prior arrangement with the Seller within 10 calendar days from the date of receipt.
2. An exchange is possible only for another product from the Store’s assortment of the same price or higher than the price of the returned product. In the case of an exchange for a higher-priced product, the exchange is possible only after paying the price difference between the exchanged products.
3. Only products that show no visible signs of use, are clean, complete, odorless, and have intact tags and labels are eligible for exchange.
4. Custom-made products are not eligible for exchange.

6. The product returned by the Client should be appropriately packaged to ensure its protection against damage during transport.
7. The cost of return shipping is borne by the Client. The cost of shipping the new product to the Client is also borne by the Client.
8. The fee for reshipping should be paid into the Store’s account, according to the cost of the previously chosen shipping method.
9. The Store will exchange the product within 14 days of receiving it.
10. The Store does not accept cash on delivery shipments.
